Terms of Service

These Terms of Service ("Terms") govern your use of websites, voice and AI interactions, scheduling, text messaging, marketing, and related services provided by Prime Marketing Experts LLC ("Prime Marketing Experts," "we," "us," or "our"), including services we provide on behalf of a client business (collectively, the "Services").

1. Acceptance and Eligibility

By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services. You must be able to form a binding agreement in your jurisdiction or use the Services with the authorization of a parent, guardian, or organization you represent.

2. The Services

The Services may include marketing, websites, AI-assisted voice or chat interactions, lead intake, customer support, appointment scheduling, requested follow-up, and communications on behalf of Prime Marketing Experts or a client business. Available features and business-specific information vary by engagement.

3. Automated Systems and Information

Some conversations may be handled or assisted by artificial intelligence. Automated responses can misunderstand a request or provide incomplete information. Unless confirmed by an authorized human or connected authoritative source, a response is not a binding price, policy, appointment, availability statement, professional opinion, or commitment by Prime Marketing Experts or a client business.

4. Prime Marketing Experts SMS Program

The Prime Marketing Experts SMS Program provides conversational customer care, information you request, appointment confirmations and reminders, service updates, and related follow-up. Promotional messages may be sent only when you provide the applicable separate consent.

• Opt-in: You may opt in through a web form, written request, keyword, or recorded verbal request. Consent to receive marketing texts is not a condition of purchase.
• Frequency: Message frequency varies based on your requests and interactions.
• Charges: Message and data rates may apply.
• Opt-out: Reply STOP to cancel. You may receive one final confirmation message, after which no further messages will be sent unless you opt in again.

• Carrier disclaimer: Wireless carriers are not liable for delayed or undelivered messages. Message delivery is subject to your carrier and device.
• Privacy: Mobile information and opt-in consent are handled as described in our Privacy Policy.

5. Calls and Recordings

Calls may be recorded, transcribed, summarized, and processed by automated systems for service delivery, quality assurance, training, security, and recordkeeping. Where required, notice or consent will be provided before recording. You are responsible for complying with applicable recording laws when you initiate or invite others into a call.

6. Client Businesses and Third-Party Services

When we provide Services for another business, that business remains responsible for its products, services, prices, policies, professional obligations, and commitments. Third-party carriers, calendar providers, platforms, payment services, and websites may have separate terms. We are not responsible for third-party services outside our control.

7. Acceptable Use

You may not use the Services to violate law or another person's rights; submit fraudulent, harmful, abusive, or misleading content; distribute malware or unsolicited communications; interfere with the Services; gain unauthorized access; or probe, scrape, reverse-engineer, or misuse our systems except where law expressly permits it.

8. Intellectual Property

The Services, including their software, designs, branding, and original content, are owned by Prime Marketing Experts or its licensors and protected by applicable law. These Terms grant only a limited, revocable, nonexclusive right to use the Services for their intended purpose.

9. Disclaimers

To the fullest extent permitted by law, the Services are provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, noninfringement, and any warranty that the Services will be uninterrupted, error-free, or produce a particular business result.

10. Limitation of Liability

To the fullest extent permitted by law, Prime Marketing Experts and its officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, revenue, data, goodwill, or business opportunities arising from the Services. Nothing in these Terms limits liability that cannot legally be limited.

11. Governing Law

These Terms are governed by the laws of the State of New Hampshire, without regard to conflict-of-law principles. Any dispute not subject to a mandatory alternative forum must be brought in a court with jurisdiction in New Hampshire.

12. Changes and Termination

We may modify or discontinue Services and may suspend access for misuse, security risk, or violation of these Terms. We may update these Terms by posting the revised version with a new effective date. Continued use after the effective date means you accept the revised Terms.
